Abstract

Cet ouvrage aborde un champ d'étude relativement nouveau en droit. En effet, la coopération transfrontière est un phénomène apparu dans le courant des années soixante, en Europe principalement. Depuis, les relations transfrontières entre villes, communes ou régions ont pris une importance croissante et constituent aujourd'hui une composante incontournable des relations internationales. Un Accord international a été adopté en 1980 au sein du Conseil de l'Europe : il est aujourd'hui ratifié par 18 États. Mais cette convention, si elle marque la reconnaissance par les États de l'émergence des pouvoirs locaux et régionaux sur la scène des relations internationales, ne résout guère les problèmes juridiques que soulève le développement du phénomène. Cette étude, constatant l'insuffisance du cadre juridique existant, propose par le recours à une terminologie nouvelle, une approche synthétique du phénomène. Située aux confins du droit interne et international, souvent entre droit privé et droit public, l'étude de la coopération transfrontière amène à considérer certains mécanismes fondamentaux du droit selon une perspective nouvelle. Par une réflexion approfondie sur les questions soulevées, cet ouvrage tente de clarifier la portée et les limites des institutions du droit interne et international qui permettent de réguler la coopération transfrontière.

Americans proudly support scientific research that yields stunning breakthroughs and Nobel prizes. We relish the ensuing debate about the implications—moral, ethical, practical—of these advances. Will genetic engineering change our basic nature? Will artificial intelligence challenge our sense of human uniqueness? And yet the actual implementation of these technologies is often sluggish and much-delayed. From Star Trek to Jurassic Park, the American imagination has always been fascinated by the power of scientific technology. But what does the reality of scientific progress mean for our society? Abstract

Doctoral thesis defended in December 1991, Building laws deals with the law of urban construction in the Roman Empire and the way it developed, applied, transformed in Italy, the Roman East and North Africa from the imperial period in the reign of Emperor Justinian.Its author, Catherine Saliou, by succeeding in creating a dialogue between law and archeology, shows the way in which neighborhood relations or overall town planning decisions can influence the construction choices of the house and vice versa.The book chooses to analyze, focusing on significant examples, what problems concretely arose in the cities of the Roman Empire, and are now noticeable or not by archaeologists.The relationships that are woven at the very borders of the house, about the dividing walls, are the most immediately perceptible issues. The supply and formation of water reserves, the disposal of wastewater, can involve more complex relationships, including the formation of networks at the district and city level. Finally, the elevation of the house is also important because it concerns both the relations between neighbors and the overall appearance of the city.

Abstract

Young interprets codification as part of a larger process that included the collapse of the Lower Canadian rebellions, the decline of seigneurialism, expansion of bourgeois democracy in central Canada, professionalization of the bar, and formation of the institutional state. Central to codification was a profound ideological shift in Lower Canadian society that gave priority to exchange and individual property rights. Young examines the evolution of codification from its nationalist origins in the 1820s and 1830s into a Civil Code that was integral to Confederation and became a flagship of bilingualism in Quebec. The formation of the commission, the work of the codifiers, and the reaction of the anglophone minority and the Roman Catholic hierarchy are considered, as is the Code's meticulous blending of a conservative social vision with the principles of freedom of property. The Politics of Codification will be of great interest to students of law, members of the legal professions, and Canadian social and legal historians.
